As a reminder, the Zoning Board of appeals is holding a hearing on whether to annul the permits granted by the Planning Board for development of Center Park to Epsilon, LLC the evening of October 5, Tuesday, at the Senior Center starting at 7 PM. In summary, besides refusing to act in the best interests of the town’s residents while permitting the Epsilon project obliterating our historic Village Green (Center Park), the Planning Board violated several procedural requirements. The board did not follow proper by-laws and state statutes regarding Notice and Opportunity to be Heard. They did not notify other boards, especially the Board of Selectmen, as required prior to granting permits. The Town Manager had the Fire Chief sign off on the letter of approval for the ridiculous special permit allowing 55 dead end parking spaces because the Public Safety Officer was virtually sure to object. The town’s residents had a right to be notified from the get-go regarding Epsilon’s application as they had a legal property interest in the land via the preservation restrictions. Yet the Board of Selectmen as the body charged with defending the residents’ legal property interests was not properly informed throughout the process. And the Town’s Building Inspector issued a Building Permit without obtaining signoff from the Board of Selectmen as required by statute. Any resident may attend and encourage the ZBA to defend the residents’ interests and annul the Planning Board permits as well as the town’s improperly issued Building Permit.
